Tobacco Compliance Checks

Area law enforcement agencies, with assistance from Fargo Cass Public Health, conduct tobacco compliance checks. When an establishment fails, the following penalties apply:

Fargo:
The 1st failure in a one year time period – one year probation.
The 2nd failure in a one year time period – 3 day suspension of the tobacco license.
The 3rd failure in a one year time period – 10 day suspension of the tobacco license.

West Fargo:

With no approved training program:

1st offense----written warning, 12 month probationary period.
2nd offense---3 day suspension of license (if within probationary period).
3rd offense---10 day suspension of license (if within probationary period).
Subsequent violations within probationary period result in a 30 day license suspension.
If any sales occur during a suspension period, the license will be suspended for the full probationary period.

With an approved training program:

1st offense---written warning, 12 month probationary period.
2nd offense---$250 administrative fine (if within probationary period).
3rd offense---$250 administrative fine (if within probationary period).
4th offense---3 day suspension of license (if within probationary period).
5th offense---10 day suspension of license (if within probationary period).
Subsequent violations within probationary period result in 30 day suspension.

March 2016

On Tuesday, March 15, the Fargo and West Fargo Police Departments conducted tobacco compliance checks, with the assistance of Fargo Cass Public Health.  In Fargo, 13 businesses were checked, two failed.  In West Fargo, 13 were checked and one failed.

The checks are a local enforcement effort to ensure tobacco retailers are not selling tobacco products, including electronic cigarettes, to minors.

Failed in Fargo:
FM International Market, 1402 Main Ave.—1st fail in twelve months
Tobacco City, 4301 13th Avenue S.—1st fail in twelve months

Failed in West Fargo:
Eagle Run Crossing, 3210 Sheyenne St.—1st fail in twelve months

December 2015

On Thursday, Dec. 10, the Fargo and West Fargo Police Departments conducted tobacco compliance checks with the assistance of Fargo Cass Public Health. In Fargo, thirty seven businesses were checked, three failed. In West Fargo, fourteen businesses were checked and one failed.

Failed in Fargo:
Phillips Travel Plaza, 2501 23rd Ave. S.—1st fail in twelve months
Discount Smoke Shop, 2301 S. University Dr., Suite #2—1st fail in twelve months
Petro Serve USA, 2921 N. Broadway—1st fail in twelve months

Failed in West Fargo:
Casey’s General Store, 901 Main Ave. E—1st fail in twelve months

September 2015

On Tuesday, Sept. 22, the West Fargo Police Department conducted tobacco compliance checks. Twelve businesses were checked, all passed. On Thursday, Sept. 24, the Fargo Police Department conducted the same compliance checks.  Seventeen businesses were checked, all passed.
